The e-commerce website www.hockeyplayer.shop is an online sales platform operated by the Public Limited Company (PLC) MPVH COMMUNICATION, with its registered office at Rue Eugène Cattoir 11, 1050 Brussels, Belgium, and registered under company number BE0450 927561 (hereinafter referred to as "Hockey Player").

The individual wishing to purchase a Hockey Player Product is referred to in these General Terms and Conditions as "the Client".

Any order for a Product offered on the Website implies the prior consultation and express acceptance by the Client of these General Terms and Conditions as outlined in Article 2.

The validation of the order form is equivalent to an electronic signature having the same value as a handwritten signature and constitutes evidence of the entirety of the order and the amounts due in execution of said order.

The sales contract can be entered into in French, Dutch, or English, at the choice of the Client.

 

Article 1 - Scope

These General Terms and Conditions define the rights and obligations of the Parties arising from the online sale of the Products offered on the Website belonging to the company Hockey Player (Belgium). The Website is intended for an international audience. Hockey Player provides all services from Belgium, and the contract is presumed to have been executed in Belgium, with shipping to the relevant country.

These general terms and conditions apply to all sales of Products made through the Website and prevail over any other conditions emanating from Hockey Player or the Client. Deviations from these Conditions must have been the subject of a prior, explicit, and written agreement from Hockey Player.

 

Article 2 - Legal Capacity and Acceptance

The person wishing to purchase a Hockey Player Product must be legally capable. A person declared incapable cannot purchase Products on the Hockey Player Site and cannot enjoy the status of Client and must proceed with their purchases through their legal representative.

The Client expressly accepts these General Terms and Conditions of sale by clicking on a checkbox or ticking a box next to the mention ("I accept the General Terms and Conditions of sale").

The Client has been given the opportunity to save and print these General Terms and Conditions.

 

Article 3 - The Products

The Products offered by Hockey Player are the products presented on the Site at the time the Client places their order, subject to the availability of the Products.

Hockey Player undertakes to make every effort to deliver all orders.

Notwithstanding this, Hockey Player cannot be held responsible for the unavailability of a Product or the damage that may result from it. If one or more Products from an order are unavailable, Hockey Player will inform the Client by email or letter that their order is either fully or partially canceled or split.

In case of unavailability communicated when the Client has already paid for their Products, Hockey Player will immediately request its bank to refund the amounts paid. The Client will be notified by email. The actual refund speed depends on the payment method used by the Client for their purchase.

In any case, Hockey Player will proceed with the refund within 30 days.

All Products offered for sale on the Website are described as accurately as possible. However, the photos appearing on the website are not contractually binding. Hockey Player disclaims all responsibility for any errors in the descriptions of the Products or in the photos, including minor differences in colors or sizes.

 

Article 4 – Prices and Invoice

The prices are the prices mentioned on the Site at the time the Client places their order.

The prices mentioned during the purchase process are expressed in euros and do not include VAT and administrative fees, unless explicitly stated otherwise.

The prices of the Products and services do not include shipping costs. These costs are invoiced separately to the Client, who must pay them in addition to the purchase price. Deliveries in Belgium are free for purchases exceeding an amount of 75 euros.

Hockey Player reserves the right to modify the sale prices and shipping costs at any time. However, the Products purchased, as well as the fees, will always be invoiced at the prices mentioned in the order confirmation email, which are the applicable prices at the time of purchase, provided that the products are available.

The Client consents to Hockey Player sending its invoice in electronic form. If the Client still wishes to receive a paper invoice, they can do so by making a simple request through the contact form.

The Products remain the property of Hockey Player until they have been fully paid by the Client, i.e., the total payment of the purchase price and fees.

 

Article 5 - Payment Methods

Purchases can only be paid for online, by [payment method icons are shown].

The Client's bank account will be debited after confirmation of the purchase, and payment will only be effective when the Client's bank has given its approval to Hockey Player. If the bank refuses the payment, the order is automatically rejected.

The Client guarantees that they are authorized to make online payments using one of the aforementioned payment methods and that the bank account linked to the credit card or Bancontact has sufficient coverage to cover all costs generated by the transaction. If not, Hockey Player may refuse the order.

Hockey Player collaborates with Ogone for the online payment processing. Ogone is the European market leader in secure online payments. The security system used by Ogone is among the most reliable and well-protected in the world. Hockey Player has no access to its customers' confidential payment data and does not store it either.

Hockey Player reserves the right to refuse any order from a Client with whom a dispute is ongoing or with whom a dispute has occurred in the past. Hockey Player may also refuse an order in case of non-payment or non-full payment of a previous order by the Client.

 

Article 6 - Ordering Products

Notwithstanding any evidence the Client may possess, it is explicitly agreed that only the data recorded in the computer system of Hockey Player, its hosting partner, or its Internet payment partner shall constitute proof of communication, the content of the order, and all transactions between the Parties.

To place an order, the Client goes to the section of their choice, selects the color and size they wish to receive, and then clicks on "add to cart." The chosen item is then added to the "shopping cart." The Client can correct their order as long as it remains in the shopping cart. To proceed with the order, the Client clicks on "order" and will then be redirected to the order form where the Client enters their contact details, the delivery address, and the payment method they wish to use.

The order is only final when the Client has accepted the General Terms and Conditions of sale by ticking the box "I accept the General Terms and Conditions of sale" and has confirmed their order by clicking on the "confirm order" button. Hockey Player will acknowledge receipt of the order by email. This acknowledgment does not constitute acceptance of the order. Hockey Player reserves the right to refuse any order for legitimate reasons, in particular, if the quantities of Products ordered are abnormally high compared to the quantities usually ordered by the Clients, or in the event of a dispute with the Client.

 

Article 7 - Delivery

Hockey Player will do everything possible to deliver the Products within the time indicated on the Site and at the latest within 30 days following the validation of the order by the Client, subject to receipt of full payment of the price and fees.

If the Products ordered are not delivered within 30 days following the order validation by the Client, the Client may terminate the contract by registered mail. The amounts paid will then be refunded to the Client within 14 days following the date of termination of the contract.

Deliveries are made to the address indicated by the Client during the ordering process. The Client must ensure the accuracy of the delivery address entered during the order validation. Hockey Player cannot be held responsible for any delivery difficulties or delays resulting from an inaccuracy in the delivery address entered by the Client.

If the delivery is refused by the Client or if the Client is absent during the delivery, Hockey Player cannot be held responsible for the resulting impossibility of delivering the Products ordered. In such a case, the delivery company will leave a delivery note at the delivery address, and the Client must contact the delivery company to arrange a new delivery date or collection from the delivery company's collection point.

If the delivery address provided by the Client is incorrect or if the Client does not contact the delivery company within the specified time frame to arrange a new delivery, the Products will be returned to Hockey Player, and the contract will be considered terminated. The amounts paid will then be refunded to the Client within 14 days following the date of termination of the contract, excluding shipping costs.

 

Article 8 - Right of Withdrawal

The Client has the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day the Client, or a third party designated by the Client other than the carrier, physically takes possession of the Products.

To exercise the right of withdrawal, the Client must inform Hockey Player of their decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email) within the 14-day withdrawal period.

The Client can use the withdrawal form template available on the Site, but it is not mandatory.

To comply with the withdrawal period, the Client must send their communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

If the Client withdraws from the contract, Hockey Player will refund all payments received from the Client, including the costs of standard delivery, without undue delay and in any event no later than 14 days from the day on which Hockey Player is informed of the Client's decision to withdraw from the contract.

Hockey Player will carry out such a refund using the same means of payment as the Client used for the initial transaction, unless the Client has expressly agreed otherwise; in any event, the Client will not incur any fees as a result of such a refund.

 

Article 9 - Returns and Refunds

Without undue delay and in any event within 14 days from the day the Client has communicated their decision to withdraw from the contract, the Client must return the Products to Hockey Player using the return procedure and the return address indicated on the Site or in the return form attached to the delivery note.

The deadline is met if the Client sends back the Products before the period of 14 days has expired.

The Client is only liable for any diminished value of the Products resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the Products.

 

Article 10 - Warranty and Conformity

The Products purchased on the Site benefit from the legal warranty of conformity provided by Belgian law.

In the event of a lack of conformity of a Product, the Client may, within two years from the delivery of the Product, request its replacement or repair, subject to the cost conditions provided for in the legal provisions in force.

In case of non-conformity, the Client must contact Hockey Player by contact form.

Replacements or repairs will be carried out within a reasonable time and without any significant inconvenience to the Client.

If the replacement or repair is impossible or disproportionate or cannot be done within a reasonable time, or if the replacement or repair cannot be done without significant inconvenience to the Client, the Client may request a price reduction or the termination of the contract.

 

Article 11 - Intellectual Property

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of Hockey Player. The Client who has a personal website and wishes to place, for personal use, on their website a simple link directly to the homepage of the Site, must request authorization from Hockey Player.

In any case, any link, even tacitly authorized, must be removed at the request of Hockey Player.

 

Article 12 - Liability and Limitations

Hockey Player cannot be held liable for any direct or indirect damage, including loss of data, files, or software. The use of the Site is the Client's sole responsibility.

The documents and information on the Site are provided without any warranty, express or implied, of any kind. Hockey Player disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights.

Hockey Player disclaims all liability for the content and legality of third-party sites that may be linked to the Site.

Hockey Player cannot be held responsible for the breach of the contract in the event of a shortage of stock or unavailability of the Product, force majeure, disruption, total or partial strike, in particular of postal services and means of transport and/or communications, flood, fire, or other disasters.

 

Article 13 - Dispute Resolution and Applicable Law

Any dispute arising from the interpretation or execution of the contract will be governed by Belgian law.

In the event of a dispute, the Client agrees to contact Hockey Player first to attempt to resolve the dispute amicably.

If an amicable settlement cannot be reached, the Client may use a consumer mediation service or any alternative dispute resolution method.

Alternatively, the Client can also use the European Commission's online dispute resolution platform, available at the following address: http://ec.europa.eu/odr.

In the event of a dispute, the Belgian courts shall have exclusive jurisdiction.

Article 15 - Modification of the General Terms and Conditions

Hockey Player reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the Site at the time the Client places their order.
